These Terms of Service (“Terms”) are a legally binding agreement between you and Blaque Spaces LLC, a Texas limited liability company (“Blaque Spaces,” “we,” “us,” “our”). These Terms govern your access and use of the Blaque Spaces waitlist website, forms, landing pages, and any related websites operated by Blaque Spaces LLC (the “Waitlist Services”).

By using the Waitlist Services or submitting your information, you:

• Acknowledge that you have read and understand these Terms,

• Agree to be legally bound by them,

• Consent to the collection and use of your information as described in these Terms and our Privacy Policy.

If you do not agree, do not use the Waitlist Services.

1. Purpose of the Waitlist Services

The Blaque Spaces waitlist website allows you to:

• Express interest in the upcoming Blaque Spaces mobile application and platform,

• Join the waitlist,

• Receive updates, announcements, and early-access information,

• Participate in surveys, beta-testing, or feedback if invited.

You are not creating an app account and you are not agreeing to the full Blaque Spaces App Terms of Service by joining the waitlist.

2. Eligibility

You must be at least 17 years old to join the waitlist.
By submitting your information, you confirm that you meet this requirement.

3. Information You Provide

By submitting your email, name, phone number, school, or any other information on the waitlist form, you agree that:

• The information you provide is accurate, current, and complete,

• You have permission to submit the information,

• Blaque Spaces LLC may use this information to contact you regarding Blaque Spaces.

You may request the removal of your information at any time by contacting us at support@blaquespaces.com.

4. Communications Consent

By signing up for the waitlist, you consent to receiving:

• Emails

• SMS messages (if you provide your phone number)

• Updates, announcements, marketing messages, surveys, and invitations

from Blaque Spaces LLC.

You may opt out at any time using the unsubscribe link or by emailing us.

5. Ownership & Intellectual Property

All content on the Waitlist Services—including text, graphics, logos, images, videos, design, and branding—is owned by Blaque Spaces LLC and is protected by copyright and trademark laws.

You may not:

• Copy, reproduce, distribute, or modify the website content,

• Misuse the website or attempt to access it unlawfully,

• Use our branding without written permission.

6. Prohibited Conduct

You agree not to:

• Use the waitlist website for fraudulent or harmful purposes,

• Attempt to hack, disrupt, or misuse our website and forms,

• Provide false information,

• Submit content containing spam, malware, or harmful code.

We may restrict or deny access to anyone violating these Terms.

7. No App Use Rights Granted

Joining the waitlist does not:

• Create a Blaque Spaces app account,

• Guarantee early access,

• Provide user privileges in the future app,

• Create any financial or membership relationship.

Actual app usage will be governed by the full Blaque Spaces App Terms of Service, which you will review and accept when the app launches.

8. Links to Third-Party Services

The Waitlist Services may contain links to third-party platforms such as:

• Instagram

• TikTok

• YouTube

• GoFundMe

• Framer

• Google Forms

• Payment processors

Blaque Spaces LLC is not responsible for third-party websites, privacy practices, or content.

9. Disclaimer of Warranties

To the fullest extent allowed by law:

• The Waitlist Services are provided “as is” and “as available.”

• We do not guarantee uninterrupted access, error-free performance, or future feature availability.

• We may modify, pause, or discontinue the waitlist website at any time.

10. Limitation of Liability

To the maximum extent permitted by law, Blaque Spaces LLC is not liable for:

• Indirect, incidental, punitive, or consequential damages,

• Loss of data, profits, or business opportunities,

• Issues caused by third-party platforms, email providers, or hosting providers.

Our total liability for any claim related to your use of the Waitlist Services will not exceed $50.

11. Indemnification

You agree to indemnify and hold harmless Blaque Spaces LLC and its officers, employees, and contractors from any claims or damages arising from:

• Your use of the Waitlist Services,

• Your violation of these Terms,

• Your submission of inaccurate or unlawful information.

12. Governing Law

These Terms are governed by the laws of the State of Texas.

13. Binding Arbitration Agreement

THIS SECTION IS LEGALLY BINDING AND AFFECTS YOUR RIGHTS.

Any dispute arising from or relating to these Terms or your use of the Waitlist Services will be resolved through binding arbitration, not in court or by a jury.

You also agree:

• Arbitration will be individual only,

• No class actions or class arbitrations are permitted,

• Arbitration will occur in Texas under AAA Consumer Arbitration Rules,

• Any claim must be filed within one (1) year of arising.

14. Modifications to the Waitlist Services

Blaque Spaces LLC may:

• Change or update content,

• Modify or remove website sections,

• Limit or discontinue the waitlist or access to it,

at any time without liability.

15. Entire Agreement

These Terms constitute the entire agreement between you and Blaque Spaces LLC for the Waitlist Services.
